Section 1

Overview

These Terms of Service ("Terms") govern your access to and use of the NIRÓU website and any purchase of products from NIRÓU Pty Ltd. By accessing our website or placing an order, you agree to be bound by these Terms.
These Terms are subject to and do not limit your rights under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law ("ACL") contained in Schedule 2.

Section 2

Products

NIRÓU produces and sells high-polyphenol extra virgin olive oil intended for dietary and general wellness use. Our Products are food products, not therapeutic goods, and are not listed or registered with the Therapeutic Goods Administration ("TGA").

Health Claims — Important

Any reference to the benefits of olive oil polyphenols is limited to the health claim authorised under European Commission Regulation (EC) No 432/2012: "Olive oil polyphenols contribute to the protection of blood lipids from oxidative stress." This applies to olive oil providing at least 5 mg of hydroxytyrosol and its derivatives per 20 g of oil. Nothing on our website constitutes medical advice. Our Products are not intended to diagnose, treat, cure, or prevent any disease or health condition. Consult a qualified healthcare professional before using our Products for any health-related purpose.

Section 3

Ordering and Payment

Placing an order:

By placing an order, you make an offer to purchase at the stated price. We reserve the right to decline any order.

Order confirmation:

An order confirmation email constitutes our acceptance of your offer and forms a binding contract, subject to these Terms.

Pricing: 

All prices are in Australian Dollars (AUD) inclusive of GST where applicable. Shipping costs are additional and disclosed at checkout. We reserve the right to amend prices; changes will not affect confirmed orders.

Payment:

Payment is processed by Shopify Payments and/or Stripe. We do not store your payment card information.

GST:

NIRÓU is registered for GST. A tax invoice will be provided on request.

Section 4

Shipping and Delivery

We ship within Australia. International shipping availability is shown at checkout. Title and risk of loss pass to you upon delivery. Estimated delivery times are indicative only. You are responsible for providing accurate delivery details.

Section 5

Returns and Refunds

Your rights and our obligations are set out in our Refund Policy, which forms part of these Terms. Nothing in the Refund Policy limits your statutory rights under the ACL.

Section 6

Australian Consumer Law Guarantees

Your statutory rights

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have Products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Section 7

Limitation of Liability

To the maximum extent permitted by law, and subject to ACL guarantees that cannot be excluded: (a) NIRÓU's liability is limited to the price paid for the relevant Products; (b) we are not liable for indirect, incidental, special, or consequential damages; and (c) we are not liable for loss arising from your reliance on wellness or health information on our website.
Nothing in this clause excludes or modifies any right or remedy under the ACL to the extent such exclusion would contravene that law.

Website Use and Intellectual Property

You may use our website only for lawful purposes. All content — text, images, logos, product descriptions, and the NIRÓU brand identity including the Phaistos Disc mark — is owned by or licensed to NIRÓU Pty Ltd and protected by intellectual property law. You may not reproduce or use any content without our prior written permission.
